WRITTEN STATEMENT ON BEHALF OF THE DEFENDANT

MOST RESPECTFULLY SHOWETH:

Preliminary Objections:

1. That the suit of the Plaintiff is not maintainable in its present form and is liable to be dismissed.

2. That the Plaintiff has not approached this Hon’ble Court with clean hands and has suppressed material facts.

3. That the suit is barred by limitation and deserves to be dismissed on this ground alone.

On Merits:

1. That the contents of para 1 of the plaint are admitted/denied as correct/false.

2. That the contents of para 2 of the plaint are wrong and hence denied. The Defendant never took any loan from the Plaintiff as alleged.

3. That para 3 is also denied. No such transaction took place on the said date.

4. That the Defendant has never signed any promissory note or document as stated in the plaint.

5. That para 4 to 8 are denied being false and baseless. The Plaintiff has concocted the story to harass the Defendant.

6. That the Defendant reserves the right to amend this written statement at a later stage if any further clarification is required.

7. That the suit is false, frivolous and filed with malafide intent to extract money from the Defendant.

PRAYER:

In view of the above submissions, it is most respectfully prayed that this Hon’ble Court may be pleased to:

a) Dismiss the suit of the Plaintiff with costs;  

b) Grant any other relief that this Hon’ble Court may deem fit and proper in the facts and circumstances of the case.
